Detailed Terms of Service
1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement between you (the "Client") and SOMA Real Estate Media ("Company," "we," "us," or "our") regarding your use of our real estate photography and media services. By engaging our services, you agree to be bound by these terms.
2. SERVICES PROVIDED
We provide real estate photography, videography, drone services, virtual tours, floor plans, social media content packages, Zillow listing optimizations, A/B testing thumbnails for performance, and related marketing media services for residential and commercial properties in the Sacramento, California area.
3. OWNERSHIP AND LICENSE RIGHTS
3.1 Client Ownership
Upon full payment, Client receives full ownership and copyright of all delivered marketing assets, including but not limited to photographs, videos, virtual tours, and floor plans created specifically for the Client's property.
3.2 Usage Rights
Client may use the delivered assets for any lawful purpose, including but not limited to:
- Marketing and advertising the photographed property
- MLS listings and real estate websites
- Print and digital marketing materials
- Social media promotion
- Transfer to third parties as needed for property marketing
3.3 Company Portfolio Rights
Company retains the right to use delivered assets for our own marketing, portfolio, website, and promotional purposes unless Client specifically requests otherwise in writing.
4. PAYMENT TERMS
4.1 Payment Due
Payment is due in full at the time of booking through our website payment system.
4.2 Service Confirmation
Services are confirmed only upon successful payment processing.
4.3 Delivery
Final deliverables will be provided according to the timeline specified for each service type.
5. SCHEDULING AND CANCELLATION POLICY
5.1 Cancellation Notice
24 hours advance notice is required to cancel or reschedule appointments.
5.2 Cancellation Fees
- Less than 24 hours notice: 50% of service fee
- No-show or same-day cancellation: 100% of service fee
- Cancellation while en route: 100% of service fee
5.3 Property Access
Client is responsible for ensuring property access. If access is unavailable at scheduled time, standard cancellation fees apply.
6. CLIENT RESPONSIBILITIES
6.1 Property Preparation
Client ensures property is clean, well-lit, and presentation-ready for photography.
6.2 Access and Safety
Client provides safe access to all areas to be photographed and informs us of any safety hazards.
6.3 Accurate Information
Client provides accurate property details, scheduling information, and access instructions.
7. DELIVERY AND QUALITY
7.1 Delivery Timeline
Standard delivery is within 24-48 hours of shoot completion unless otherwise specified.
7.2 File Format
Images delivered in high-resolution JPEG format unless otherwise requested.
7.3 Quality Standards
We maintain professional quality standards. If Client is unsatisfied with delivered work, we will reshoot at no additional charge if notified within 7 days of delivery.
8. LIABILITY AND DISCLAIMERS
8.1 Limited Liability
Our liability is limited to the amount paid for services rendered.
8.2 Property Damage
We maintain liability insurance. Any accidental damage will be addressed through our insurance coverage.
8.3 Weather and Circumstances
We are not liable for delays or rescheduling due to weather, property conditions, or circumstances beyond our control.
9. INDEMNIFICATION
Client agrees to indemnify and hold harmless Company from any claims, damages, or expenses arising from Client's use of delivered assets or any breach of these terms.
10. PRIVACY AND DATA
We respect Client privacy and will not share personal information with third parties except as necessary to provide services or as required by law.
11. MODIFICATIONS
These terms may be updated periodically. Current terms are available on our website. Continued use of our services constitutes acceptance of updated terms.
12. GOVERNING LAW
These terms are governed by California law. Any disputes will be resolved in Sacramento County, California.
13. ENTIRE AGREEMENT
These terms constitute the entire agreement between parties and supersede all prior agreements or understandings.
